Terms of service
These terms are an agreement between Webtalez Digital, a sole proprietorship registered in Maharashtra, India ("Tarko", "we", "us"), and the business that installs or signs up for Tarko Report (the "brand", "you"). They also apply to each person the brand gives a seat to. By installing Tarko from Shopify, connecting an account, or signing in, you agree to them. If you accept them for a business, you confirm you are allowed to bind it.
1. The service
Tarko Report (the "service") combines data from a brand's Shopify store and the Meta Ads, Google Ads, Google Analytics 4 and Google Merchant Center accounts the brand connects into reports, alerts and email digests. It is available as an app inside Shopify admin and as a web app at tarko.report that can be added to a phone's home screen. We may improve and change the service over time. If we remove a major feature you pay for, we will tell you in advance.
2. Accounts, seats and roles
- The person who installs Tarko on a store is its Owner. The Owner assigns seats by email address and chooses each seat's role.
- Each seat is for one named person. Seats can't be shared, but the Owner can move a seat to someone else.
- You are responsible for who you give seats to, for keeping sign-in access secure, and for activity under your seats. Tell us promptly at hello@tarko.report if you suspect unauthorised access.
3. Connecting your accounts
You may connect only accounts that you own or are authorised to connect. Tarko accesses them read-only for reporting, under the permissions you grant, and you can disconnect them at any time. Your use of Shopify, Meta and Google stays subject to their own terms.
4. Plans, billing and the pilot
- Paid plans are charged through Shopify, as recurring app charges on your Shopify bill. The plans, seat limits and prices are those shown in the Shopify App Store listing and in the app when you approve the charge. Shopify's terms govern payment, and taxes are added as Shopify applies them.
- Extra seats beyond your plan are charged as shown in the app before you add them.
- You can change or cancel your plan in the app at any time. Cancelling, or uninstalling the app, stops future charges. Fees already charged are not refundable, except where the law or Shopify's policies require.
- Brands in our pilot programme use a private version of the app at no charge, for the period we agree with them. The pilot may have bugs and changes.
- We may change prices for future billing periods with at least 30 days' notice. The new price applies only once you approve it in Shopify.
5. Your data
- You keep all rights to your data. You give us permission to process it only to provide, secure and improve the service for you, as described in our privacy policy.
- We act on your instructions for data about your shoppers. You are responsible for having a lawful basis to share it with us, and for your own privacy notices to your shoppers.
- We may use aggregated, anonymised technical measures (for example, how long syncs take) to run and improve the service. These never identify you, your store or your shoppers, and never include data received from Google APIs except as the Google API Services User Data Policy allows.
- When you uninstall or close your account, we delete your data as set out in the privacy policy. You can export your reports before you leave.
6. Acceptable use
You agree not to:
- access another brand's data or try to get around seat, role or security controls;
- reverse engineer, scrape or overload the service, or test its security without our written permission;
- resell the service or provide it to third parties as your own;
- use the service for anything unlawful, or in breach of Shopify's, Meta's or Google's terms.
7. Accuracy of reports
Reports depend on data from Shopify, Meta and Google, which can be delayed, sampled, thresholded for privacy, or restated after the fact. We label each number with its source and show how fresh it is, and we check our totals against the platforms. Even so, figures may differ from the platforms' own reports, and insights and recommendations (such as "where to focus" or scale-and-kill suggestions) are guidance based on rules you can see. Business decisions, including ad spend, stock orders and pricing, remain yours. Tarko does not give financial, tax or legal advice.
8. Availability and support
We aim to keep the service available and data current, but we don't guarantee it will be uninterrupted or error-free, especially when a connected platform is unavailable or changes its API. Support is by email at hello@tarko.report.
9. Intellectual property and feedback
We own the service, its software, design and the Tarko name. These terms give you a non-exclusive, non-transferable right to use the service while your account is active. If you send us suggestions, we may use them without obligation to you.
10. Confidentiality
Each of us will keep the other's non-public business information confidential and use it only for the purpose of these terms, except where disclosure is required by law.
11. Suspension and termination
- You can stop using Tarko at any time by uninstalling it from Shopify or asking us to close your account.
- We may suspend or end access if you seriously breach these terms, if required by law, or if a platform withdraws our access. Where reasonable, we will warn you first and give you a chance to fix the problem.
- Sections 5, 7, 9, 10, 12, 13 and 14 continue after termination.
12. Disclaimer
Except as these terms say, the service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the extent the law allows, neither of us is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data, arising from these terms or the service. Our total liability for all claims in any 12-month period is limited to the fees you paid for the service in those 12 months, or ₹10,000 if greater. Nothing here limits liability that cannot be limited by law.
14. Governing law and disputes
These terms are governed by the laws of India. The courts at Mumbai, Maharashtra have exclusive jurisdiction. Before going to court, we will both try in good faith to settle any dispute by discussion for 30 days.
15. Changes to these terms
We may update these terms. We will post the new version here with a new date, and tell Owners by email at least 30 days before a material change takes effect. Continuing to use the service after that date means you accept the change.
16. General
These terms and the privacy policy are the whole agreement between us about the service. If any part is unenforceable, the rest still applies. You may not transfer these terms without our consent; we may transfer them as part of a reorganisation or sale of the business, with notice to you. Neither of us is responsible for delays caused by events beyond reasonable control.
